Hire Terms & Conditions

DEFINITIONS

COMPANY: means AJVS Pty Ldt ATF The Mohana Trust (ABN 34 881 980 380) trading as Birds of a Feather WA. 

HIRER: means the person, company or organisation hiring goods from Birds of a Feather WA. 

GOODS: refer to any goods, equipment, consumables, packaging material and or services provided by  the owner to the hirer 

SITE: means the site to which the goods are delivered. 

HIRER REPRESENTATIVE: means the person, other than the hirer, signing for goods delivered or  returned in the event that the hirer should be absent at the point of time of delivery or return of the  hire items. 

QUOTES PRICES

Quotes are valid for 30 days, after which prices may change without any notification from the company.. Once the proper procedures have been followed to confirm an order, only then are prices fixed and guaranteed. 

Prices charged only entitle the Hirer to a single use of the hire goods, unless stated otherwise on the  order or invoice. Multiple uses of the hire goods will result in corresponding hire charges. 

CONFIRMATION OF BOOKING & DEPOSITS  

A “Tentative Booking” will be held for a maximum of 14 days after which time Birds of a Feather WA  reserves the right to release the date. 

A determined booking deposit is required in order to confirm the booking and secure the chosen date. This  deposit will be deducted from the total invoice once paid. Please note this deposit is non-refundable & non-transferable. 

PAYMENT OF INVOICE  

Final payment is required 30 days prior to the function date, and failure to do so may, to the discretion of the company, result in cancellation of the event upon which the Hirer will forfeit their right to the deposit. 

AMENDMENTS, VARIATIONS AND CANCELLATIONS  

Ordered Items cancelled after 7 days from the confirmed order date will be charged 20% of the full  hire price. 

Orders cancelled within 7days prior to the function date will be charged at 100% of the full  order price. 

Ordered items cancelled after delivery or pickup will be charged for at the full hire price. The company reserves the right to cancel any orders on the bases of unsatisfactory working conditions; unsatisfactory weather conditions or if the owner feels that for any reason the hire equipment is in  danger of being stolen or damaged. 

If the company is unable to provide goods to the Hirer, for reasons outside of its control, then the company  may: make suitable changes to the order, or cancel the order (even if full payment has been received), upon which the company will forfeit all rights to the hire fee and a refund will be made accordingly. 

 

SURCHARGES 

A15% surcharge is payable on Public Holidays and Special Occasion Days.(Valentines, St Patrick’s Day, Christmas Eve, ChristmasDay, BoxingDay, NewYears, Australia Day, Easter weekend, Anzac Day…) 

COVID 19 CLAUSE  

In the event that hire items are affected by COVID19 (Lockdown in WA, Guest Number Restrictions), a partial refund of all amounts paid is given. This is only in the event that your reschedule date is not available. Booking Deposits paid are non-refundable and any items or consumables purchased specifically  for your event such as fresh florals, coloured candles, tea/coffee supplies etc. will be deducted from the  balance also. Credit notes can be provided upon request, in order for you to transfer the amount to another  potential client or to be used for a future event. (Subject to BoaF date availability) 

QUALITY CONTROL  

All of our items are intended for repeated use and therefore may have slight signs of wear and tear. However, the company has inspection procedures in place to ensure that items delivered for hire are in good quality and in the quantity as described on the invoice. It is the Hirer's responsibility to ensure notification of any shortages or damages to the delivered goods before use. 

SET-UP & PACKDOWN  

A drop off location, time and contact person must be provided prior to the booking. You must ensure you  have the correct permissions/permits and bookings at the venue. Vehicle access must be granted to our  staff with a minimum of 3 hours beforehand to set up. This will be determined by both parties. A site  inspection may be required prior to the event to ensure we can carry out the necessary functions. 

COLLECTION OF HIRE ITEMS  

All items will be collected after the event at an equally agreed upon time. It is your responsibility to store  in an accessible place and out of the elements if required. In the event that our items are left in the rain,  and this causes damage - you will be required to cover the cost of replacement. (See below) 

HIRE PERIOD  

The Hirer will take full responsibility for all hired items as listed on the Invoice for the duration of the  hire period, which constitute the period between the times of delivery/pickup to the time of return of goods to the Owners premises. The Hire period will be for a maximum of 1 day if undisclosed, otherwise all hire items need to be returned prior to the date specified. 

Although the hire period might be for a period of multiple days this does not entitle to Hirer multiple use of the hire goods, unless stated otherwise on the packing slip/ order or invoice. 

HIRE REPRESENTATIVES  

In the event that the Hirer should be absent at the point and time of delivery and/or return of the hire goods, the person accepting the delivery and/or confirming the returned goods from the Hirer, will  act as the Hirer Representative, and subsequently the Hirer will remain responsible for damages and / or losses as confirmed by the Hirer Representative in respect to the delivery docket. 

RETURNS  

Upon the collection/return of goods the company has the right to count the goods once it arrives back at the company’s premises, upon which, the Hirer will remain responsible for any losses or damages. All items returned after the due date as outlined on the Quote/Order/Invoice or Delivery Docket will incur additional late return charges, according to the following schedule: 

  • Late returns, will incur a multiple 100% Surcharge of the original hire fee for every week not  returned after the function date. 

DAMAGES / MISSING GOODS  

Upon receiving the returned goods, the company  will inspect all goods and if any damages, losses or equipment in unsatisfactory condition are found then the Hirer shall compensate the company for all expenses required to replace, fix or clean the affected goods. 

All linen items returned with holes, burns, rips, tears or any other permanent markings will be  charged at a full replacement cost. 

Replacement charges will be limited to marks that are considered permanent as a result of the inability to remove them by means of ordinary laundry treatment.  

Full replacement cost is the responsibility of the Hirer for any items, linen or equipment lost or stolen during the hire period, which commences at the time of delivery or pickup to the time of return to the  company’s premises. 

The Hirer will have 21 days from the invoice date to return any missing goods. For every day that the missing goods are not returned, a hire fee will apply as outlined in section (Late returns) until the day returned. 

Missing Goods returned after 21 days from the invoice date will not be accepted by the Owner but will be subjected to full replacement cost instead. All these charges mentioned above will be the full  responsibility of the Hirer and shall not pass to a third party, unless written confirmation is obtained  from a third party, which expressively accepts the full expense of the charges mentioned above. 

BOND  

A security bond will be agreed upon and clearly stated on your invoice. This amount varies between clients  and will be dependent on the total amount of the hired items. 

Missing or damaged items will be deducted from the bond at full replacement cost. An appropriate refund will be made when the missing goods are returned in conjunction with the terms. In the event that the bond should not cover the full charge for missing/damaged goods, an invoice  will be issued and will be payable immediately. 

The bond will be refunded within 7 days from the time of return of all hired items found to be in satisfactory condition.  

INSURANCE AND INDEMNITY  

Birds of a Feather WA does hold Public Liability Insurance Cover to the value of 5 Million Dollars. This covers  any accidents or injuries that occur as result of business activities, as well as accidental damage to property owned or controlled by someone else. 

Our Hire items are however not insured. The Hirer accepts full responsibility for all items hired and is  responsible for all damages or losses that occur whilst under their hire period. Any loss or damage  will be deducted accordingly from the BOND as outlined above. 

The Company will not be liable for any losses or expenses incurred by the Hirer following the failure to meet delivery dates. Failure by the Owner to act on any of these terms and conditions does not mean that the Hirer is acquitted from any other responsibility as outlined by the terms and conditions. 

ADDITIONAL TERMS  

The hirer is responsible for any necessary permits or to lodge any applications with councils or establishments. For example, outdoor/public venues and consumption of alcohol. Birds of a Feather WA is not responsible for purchasing alcohol. If bar service is required, we ensure that our staff have necessary RSA certification and experience. 

Arbours, Market umbrellas, Festoon lights, backdrops, marquees and other props may be deemed  unsuitable in wet/windy or unreasonable conditions; this will also be communicated with the hirer. In this  event, items will be replaced with similar items or the cost will be refunded post event. Some items will need to be secured with hooks, rope, cable ties, tape and by other means. The hirer will need to discuss this with the establishment or venue prior if required. 

PRIVACY  

All our customers’ personal details are secured. We will not share this information with anyone. I agree to and understand the Terms and Conditions of this Hire Agreement. 

HIRER ACCEPTANCE OF TERMS AND CONDITIONS  

The Hirer acknowledges unconditional acceptance of these terms and conditions by act of taking  possession of the hired items by means of delivery or pickup.
